Outsourcing AI automation to India: what to check first

By Shreekant Pratap Singh, Founder, Technosys IT Management · Updated · 6 min read

Short answer

Check five things: how the partner protects your data under your law and India’s Digital Personal Data Protection Act, 2023; whether it signs an NDA and a data processing agreement; how working hours overlap with yours; who owns and controls the workflows; and named proof of past work with measured results.

Key takeaways

  • India’s Digital Personal Data Protection Act, 2023 now has operational rules, notified in November 2025.
  • Your own obligations, such as GDPR for EU data, still apply when you outsource.
  • Agree working-hour overlap and response times in writing.
  • Prefer partners who build inside accounts you control.

Data protection and contracts

Ask which laws the partner works under and how it applies them to your data. In India that includes the Digital Personal Data Protection Act, 2023, whose rules were notified in November 2025 with obligations phased in over the following 18 months. For EU personal data, GDPR obligations stay with you as the controller, so you need a data processing agreement.

Sign an NDA before sharing process details, and a data processing agreement before any production work touches personal data. Confirm which AI providers will process your data and on what terms.

Time zones and communication

India Standard Time is UTC+5:30. That gives a working-day overlap with the UK and the UAE, and an early-morning or late-evening overlap with the US. Many teams treat the gap as an advantage: work submitted at the end of a US day is done by the next morning.

Agree a fixed overlap window, a named contact, and response times in writing.

Ownership, access and exit

Ask where the workflows will run. Building inside your own platform accounts means you keep control if the relationship ends. Insist on documentation, least-privilege access and a clean hand-over of credentials at exit.

Proof

Look for named clients, independent reviews on platforms such as Clutch, and case studies with before-and-after numbers. Ask to speak to a client in your region.
